1. Agreement to Terms
By accessing or using ServiceTiket ("Platform"), a product of Formobi Solutions Pvt. Ltd. ("Company", "we", "us"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Platform.
2. Platform Description
ServiceTiket is a configurable SaaS platform for enterprise asset management, workflow automation, and field operations. The Platform is provided on a subscription basis as detailed in your Enterprise Agreement.
3. User Accounts
- Enterprise administrators are responsible for managing user accounts and access levels.
- Users must maintain the confidentiality of their login credentials.
- Each user account is for a single individual and may not be shared.
- You must immediately notify us of any unauthorized use of your account.
4. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws.
- Attempt to reverse engineer, decompile, or disassemble any part of the Platform.
- Upload or transmit viruses, malware, or other malicious code.
- Access data or accounts not intended for you.
- Resell, sublicense, or redistribute access to the Platform without authorization.
5. Intellectual Property
All Platform code, design, trademarks, and documentation are the exclusive property of Formobi Solutions Pvt. Ltd. Your subscription grants a limited, non-exclusive, non-transferable license to use the Platform during the subscription term.
Customer data uploaded to the Platform remains the property of the customer. We claim no ownership of your data.
6. Data Processing
We process your data as described in our Privacy Policy. For enterprise clients, data processing is governed by the Data Processing Agreement (DPA) included in your Enterprise Agreement.
7. Service Level Agreement
- Uptime: We target 99.9% platform availability.
- Support: Enterprise support is available via email and WhatsApp during business hours (IST).
- Maintenance: Scheduled maintenance windows will be communicated at least 48 hours in advance.
8. Payment Terms
Subscription fees are as detailed in your Enterprise Agreement. Invoices are payable within 30 days of receipt. Late payments may result in service suspension after written notice.
9. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claims arising from or related to the Platform shall not exceed the fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.
10. Termination
Either party may terminate the agreement with 30 days written notice. Upon termination, your data will be available for export for 30 days, after which it will be permanently deleted.
11. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.
